Terms & Conditions
These are the Terms & Conditions (hereafter referred to as "Terms") of USAtogo. These Terms define the contractual relationship between the operators of USAtogo (hereafter referred to as "USAtogo", "we", "us" and "our") and the individual or legal person (hereafter referred to as "Customer" or "User") using the USAtogo services.
1. Purpose of this platform
What we are
USAtogo.org is a platform, where Customers can submit their Green Card lottery application relevant data, so USAtogo can offer a service to check for formal errors, notify the Customer about those errors and if requested, enter their application data in the official US Diversity Visa lottery as well as checking the outcome of the lottery on their behalf. USAtogo charges a fee for these services.
What we are NOT
Please be aware, that USAtogo is NOT affiliated with any US authority. In particular, USAtogo.org is NOT the official US Diversity Visa program website. Participating in the DV lottery is completely free and anybody can enter directly on the official website www.state.gov.
Bottom line: What USAtogo offers, is an additional, fee-based service to help you avoid mistakes in your application, that could lead to a disqualification in the official lottery.
2. Being a Customer
2.1 Signing up
Using the services of USAtogo requires signing up as a Customer, which means providing a (correct) e-mail address to create an account ("Account") to submit and manage the data required for the services. There is no entitlement to signing up. Signing up is free of charge and only possible if you completely agree to these Terms. With signing up, a contractual relationship (hereafter referred to as "Contract") between the Customer and USAtogo is in effect. Signing up is only allowed for absolutely contractually capable individual or legal persons.
A Customer's account is not transferable. If there are any doubts regarding the sincerity of a registration, USAtogo reserves the right to reject the Customer Account activation, services in general or remove the Account.
2.2 Provided contents
The Customer is responsible for all contents and data submitted in the forms. The Customer needs to ensure that all selected or personally entered contents are correct. USAtogo will only be able to check for formal errors. The Customer on the other hand needs to make sure all the entered data (such as date of birth, passport numbers but also everything else) is contentually correct.
3. Scope of services
3.1 General conditions
We reserve the right to refuse service to anyone for any reason at any time. Specifically, when placing an order with us, we reserve the right to cancel that order and, instead of providing our service, refund the Customer for any reason.
3.2 Service packages
USAtogo offers several services around the Green Card lottery. Two specific service packages we offer among others are
Data Check Package
Once the Customer submitted all necessary application data (including photos) and paid the service fee, USAtogo checks if all data of the application satisfies the official guidelines of the Visa Diversity program as defined by the US authorities and - if possible errors are detected - notifies and guides the Customer to correct those errors. Important: USAtogo can and will only check for formal errors following the official requirements such as the strict requirements for the photos and the format of the data entered. The Customer is solely responsible for the accuracy of the correctness of the contents, such as, but not limited to, the names, date of birth or passport information.
Full Service Package
This package includes the service as described in the Data Check Package but in addition it offers submitting the application on schedule to the official lottery for the Customer, as well as checking the outcome of the lottery and notifying the Customer about all updates regarding the lottery and the Customer's application.
3.3 Beginning of service
The order of the service is confirmed with the receipt of the payment for the according service fee. For the then following check of the Customer's application data, all necessary data (including the photos) needs to be provided by the Customer, before USAtogo can fully validate the application and, if applicable, notify the Customer about required changes.
3.4 Data changes by the Customer and Deadline
Submitted Customer data can be changed using the Customer's Account at anytime, as long as USAtogo's entry deadline ("Deadline") has not passed yet. USAtogo's Deadline is exactly 14 days before the entry deadline of the official Diversity Visa lottery (usually end of October or beginning of November). If the Customer fails to provide all data and corrections (as advised by USAtogo after our check) necessary on time before the Deadline, USAtogo cannot submit the application to the official lottery (in case the Customer booked the Full Service Package) and will not proceed to check applications again, if data is being changed or provided in full by the Customer after the Deadline. There will be no refunds, if the Customer fails to provide all the necessary data and/or required changes on time before the Deadline.
3.5 Impossibility of performance
If for any reason, for example (but not limited to) force majeure, technological limitations, changes to the laws and rules or the complete termination of the Diversity Visa lottery, the Green Card lottery is not being held in the year of the Customer's participation and the submission of the Customer's participation in the lottery is not possible,
- there will be no refund for the Data Check Package
- in case the Full Service Package was booked, the Customer is entitled to a 50% refund of the originally invoiced amount for that package
- any other services booked will not be refunded
3.6 Errors, inaccuracies and missing information
Occasionally descriptions and information about and around our services might contain errors, might be inaccurate or might be missing. We reserve the right to correct those errors and inaccuracies or add new information at any time without prior noticing the Customer (including after the Customer has ordered one of our services).
4. Responsibility for contents
USAtogo does not take on any responsibility for the contents, data, and/or information provided by the Customers and neither for the contents on the websites that are externally linked to the USAtogo.org website. USAtogo particularly does not guarantee that these contents are truthful, serve a certain purpose, or are able to answer such a purpose.
USAtogo tries to ensure that automated contents are correct and do not violate statutory provisions, third party rights or public policy. When data and content is provided by third parties, the respective third party is responsible for correct and accurate data and content.
5. Exclusion and termination
USAtogo reserves the right, to exclude a Customer from the portal, as soon as one of the following reasons exist:
- false statements regarding provided information
- abuse of the portal or the services of any kind
- violation of these Terms
If a Customer Account has been suspended or a Customer has been banned from the portal, it is prohibited to create a new Account using a different name and/or email address.
6. Exclusion and limitation of liability
If the User incurs disadvantages due to server down time, transmission errors, programming errors ("bugs") or any other malfunctions using the USAtogo.org website, then the User is not entitled to compensation and USAtogo shall not be liable. There are no warranties in terms of availability and/or quality of our services/website.
USAtogo reserves the right to make changes to the website at any time.
USAtogo disassociates themselves from User generated contents, which
- include unethical, pornographic, racist content or content which is harmful to youths or glorify violence or links to third party websites which include such content.
The User is solely responsible for submitted or published content.
We do not guarantee that the use of our services will be timely, secure, accurate, reliable or error-free. You explicitly agree, that using our services is at your sole risk.
With signing up at USAtogo.org, the Customer agrees to the fact that USAtogo is storing personal data including (but not limited to) last name, first name, address and email address in our databases.
The User exempts USAtogo from all requirements of other Customers or a third party regarding copyrights, trademarks, patents and other intellectual property rights in any material or content (including information, text, images, logos, symbols and other material). The Customer therefore also undertakes all costs for legal defence of USAtogo including all legal and lawyer costs. This does not apply if no liability for the infringement can be found.
Any attempts to manipulate the USAtogo.org portal and its operability are strictly prohibited and will be prosecuted.
10. Place of jurisdiction
Place of jurisdiction shall be Berlin, Germany. The courts of Berlin, Germany shall have jurisdiction over all disputes arising from the Contract. German law shall apply.
11. Severability and Miscellaneous
USAtogo reserves the right to change these Terms at any time without stating a reason. Changes will be communicated (by e-mail) to the Customer at least two weeks berfore taking effect. If the Customer does not express disagreement in written form within two weeks of being notified about the changes, those changes are regarded as accepted.
The unenforceability or invalidity of any clause in this Contract shall not have an impact on the enforceability or validity of any other clause. Any unenforceable or invalid clause shall be regarded as removed from this Contract to the extent of its unenforceability and invalidity. Therefore, this Contract shall be interpreted and enforced as if it did not contain the said clause to the extent of its unenforceability and invalidity.
